The terms and conditions governing your use of Millibar
These Terms and Conditions ("Terms") govern your access to and use of the Millibar platform, available at millibar.io and its subdomains (the "Service"), operated by MBAR Millibar Technologies UG (haftungsbeschränkt) ("Millibar", "we", "us", or "our"), a company registered in Germany.
Please read these Terms carefully before using the Service. By accessing or using the Service you agree to be bound by them. If you do not agree, you may not access the Service.

1. Registered Accounts and Diver Profiles
To access certain features of the Service you must create an account. When registering, you must provide accurate, complete, and current information and keep it up to date at all times. Failure to do so constitutes a breach of these Terms and may result in suspension or termination of your account.
As a registered user you may create and maintain a diver profile containing personal information such as your name, contact details, diving certifications, insurance status, dive logs, and preferences. You are solely responsible for the accuracy and completeness of the information you enter into your profile.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at hello@millibar.io upon becoming aware of any unauthorized access to or use of your account. You may not use a username that infringes any third-party right or that is otherwise offensive, vulgar, or obscene.
2. User-Generated Content
The Service allows you to upload, store, and manage content such as diving certifications, signed documents, dive log entries, profile photographs, and other materials ("Content"). You are solely responsible for the Content you submit, including its legality, accuracy, reliability, and appropriateness.
By submitting Content you grant Millibar a non-exclusive, worldwide, royalty-free licence to store, display, and process that Content solely for the purpose of providing and improving the Service. You retain all ownership rights in your Content. You represent and warrant that you own or have the necessary rights to submit the Content and that doing so does not infringe the rights of any third party.
Millibar reserves the right to remove any Content that violates these Terms or applicable law, without prior notice.
3. Dive Center Directory
Millibar maintains a public directory of dive centers ("Directory"). Listings in the Directory may be created by Millibar using publicly available information, including business names, addresses, contact details, websites, services, and location data sourced from official websites, public registers, map services, social media platforms, and industry directories.
Directory information is provided for informational purposes only. Millibar does not guarantee the accuracy, completeness, or currency of any listing. Users should verify all relevant information directly with the dive center before booking or travelling.
Authorized representatives of a dive center may request to claim, correct, update, or have removed their listing by contacting us at hello@millibar.io. Claiming a listing means taking responsibility for keeping its information accurate. It does not, in itself, confer Partner status.
4. Partner Status
Certain dive centers in the Directory are designated as Millibar Partners. Partner status reflects an active and ongoing collaboration between the dive center and the Millibar network, based on a separate agreement.
Millibar Partners may receive increased visibility in the Directory and on the platform. This increased visibility is a benefit of the partnership arrangement and not a form of endorsement or ranking based on quality or safety.
Partner status is not a quality mark, safety certification, accreditation, or endorsement by Millibar. Users should conduct their own due diligence before booking with any dive center, regardless of its Partner status.

5. Intellectual Property
The Service and its original content, features, and functionality — excluding Content submitted by users — are and will remain the exclusive property of MBAR Millibar Technologies UG (haftungsbeschränkt) and its licensors. The Service is protected by copyright, trade mark, and other applicable laws. Our trade marks and trade dress may not be used in connection with any product or service without our prior written consent.
6. External Links and Third-Party Services
The Service may contain links to third-party websites or services. These links are provided for convenience only. Millibar has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party site or service.
We strongly recommend that you read the terms and conditions and privacy policies of any third-party site or service you visit. Your use of third-party services is at your own risk.
7. Account Suspension, Termination, and Content Removal
Millibar reserves the right to suspend or terminate your account, restrict your access to the Service, or remove Content at any time and without prior notice if we believe you have violated these Terms, applicable law, or acted in a manner harmful to other users, dive centers, or the platform.
You may request deletion of your account at any time by contacting us at hello@millibar.io. Upon account deletion, your profile and associated Content will be removed in accordance with our Privacy Policy. Certain data may be retained where required by law or legitimate operational need.
Termination of your account does not affect any rights or obligations that arose before the termination date.
8. Limitation of Liability
To the fullest extent permitted by applicable law, MBAR Millibar Technologies UG (haftungsbeschränkt), its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising from: (i) your access to or use of, or inability to access or use, the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service, including dive center directory listings; or (iv) unauthorised access, use, or alteration of your transmissions or Content.
9. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Millibar does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components, or that any errors or defects will be corrected. Dive center listings are sourced from publicly available data and may be incomplete, inaccurate, or out of date. Millibar is not responsible for any loss or damage arising from reliance on directory information.
10. Artificial Intelligence
The Service may use AI-powered features to enhance the platform experience. These features are powered by third-party AI APIs, including Anthropic, and may in the future include locally hosted AI models. AI agents operate on data you provide to the Service solely to deliver and improve the features offered.
Your data is not used to train external AI models. AI-generated outputs are provided for informational purposes only and do not constitute professional advice. Millibar is not liable for any decisions made based on AI-generated content.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Germany, to the extent permitted by applicable law.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes to These Terms
Millibar reserves the right to modify these Terms at any time. We will notify users of material changes through the Service and, where reasonably practicable, by email to the address associated with your account, at least 15 days before the changes take effect. What constitutes a material change is determined at our reasonable discretion.
By continuing to access or use the Service after revised Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may request deletion of your account.
